Skyllamas Performing Arts Center Terms and Conditions

Welcome to Skyllamas Performing Arts Center. By enrolling in our classes, workshops, or any activities associated with our academy, you agree to the following terms and conditions:

1. Assumption of Risk

I HEREBY ASSUME ALL OF THE RISKS OF PARTICIPATING IN THIS ACTIVITY, including by way of example and not limitation, any risks that may arise from negligence or carelessness on the part of the persons or entities being released, from dangerous or defective equipment or property owned, maintained, or controlled by them, or because of their possible liability without fault. I understand that there are risks of physical injury associated with, arising out of, and inherent to dancing and to the performing arts. These risks include the potential for slips and falls, sprains, strains, dislocations, soft tissue injuries, musculoskeletal injuries, pediatric conditions, and other risks not specified here. Understanding these risks and the potential for others not listed, I agree to personally accept and assume all of the risks present in my participation at Skyllamas Performing Arts Center. My participation at Skyllamas Performing Arts Centeris entirely voluntary, and I choose to participate in spite of the risks.

2. Hands-on Instruction

Dance and acting education sometimes require hands-on instruction as well as verbal instruction. Instructors may correct students by touching their arms, legs, feet, hips, back, and head to move them into the correct position. I acknowledge that this is a common standard in dance and acting instruction and understand that it is my responsibility to communicate clearly with my teacher and/or the director if any form of touch is unacceptable to me. I will also inform Skyllamas Performing Arts Center’s management in writing.

3. Physical Fitness Certification

I certify that I am physically fit, do not pose a health risk to the public, have sufficiently prepared or trained for participation in the activity or event, and have not been advised to not participate by a qualified medical professional. I certify that there are no health-related reasons or problems which preclude, limit, or otherwise negatively impact or impede my participation in this activity or event. I choose to participate in classes, performances, workshops, and other activities at or associated with Skyllamas Performing Arts Center of my own free will and certify that I am in proper physical condition to take part in such activities. If I have questions about whether an activity is suitable for me to pursue, I will consult my healthcare provider in making that decision. If I have any known physical vulnerabilities, conditions, or injuries, I agree to disclose them to Skyllamas Performing Arts Center’s management in writing before participating.

4. Release and Waiver of Liability

By signing this document, I release Skyllamas Performing Arts Center and their directors, owners, students, teachers, staff, employees, volunteers, associates, as well as all tenants and landlords in the locations where my instruction/performance/activity takes place (collectively referred to in this document as “Skyllamas” or “Skyllamas Parties”) from any liability or claim that I or my representatives may have against Skyllamas with respect to any bodily injury, personal injury, illness, death, or property loss or damage that may result from my participation in activities at or associated with Skyllamas Performing Arts Center (including also, for avoidance of doubt, injuries, sickness, pandemics, accidents, natural disasters, and/or acts of God incurred during participation in and/or instruction of camps, private lessons, or any activity I may participate in).

I voluntarily release and forever discharge and hold harmless Skyllamas from any and all claims or demands for damages, loss of services, costs and expenses, injuries, attorney fees, and any other call for reparation from any and all injury to me or my property arising in any way from my participation in dance classes, camps, intensives, workshops, performances, troupes, the use of Skyllamas or Skyllamas associated equipment or facilities, and any activities associated with Skyllamas. The accident waiver and release of liability shall be construed broadly to provide a release and waiver to the maximum extent permissible under applicable law.

5. Code of Conduct

Students are expected to maintain a high standard of behavior at all times. This includes showing respect to instructors, fellow students, and academy property. Any disruptive or inappropriate behavior may result in dismissal from the Skyllamas Performing Arts Center without refund.

6. Attendance and Punctuality

Regular attendance is crucial for progress in the performing arts. Students are expected to attend all scheduled classes, rehearsals, and performances punctually. In case of absence, students should inform our Skyllamas Performing Arts Center in advance.

7. Payment Policies

Tuition and fees must be paid on time as per the academy’s schedule. Late payments may incur additional fees. Refunds will only be provided under specific conditions as outlined in our refund policy.

8. Refund Policy

Tuition fees are non-refundable except in cases of medical emergencies or other extenuating circumstances approved by the management. Requests for refunds must be made in writing and accompanied by relevant documentation.

9. Media Release

By participating in activities at Skyllamas Performing Arts Center, students consent to the use of their image, likeness, and performance for promotional materials, including but not limited to photos, videos, and recordings.

10. Privacy Policy

Skyllamas Performing Arts Center respects the privacy of its students and is committed to protecting personal information. Any personal information collected will be used solely for academy-related purposes and will not be shared with third parties without consent.

11. Intellectual Property

All choreography, scripts, and other creative materials provided by Skyllamas Performing Arts Center are the intellectual property of the academy and may not be used or reproduced without permission.

12. Governing Law

These terms and conditions shall be governed by and construed in accordance with the laws of the state of New Jersey. Any disputes arising out of or in connection with these terms and conditions shall be subject to the exclusive jurisdiction of the courts of New Jersey.

13. Acceptance of Terms

By enrolling in Skyllamas Performing Arts Center, you acknowledge that you have read, understood, and agree to abide by these terms and conditions. Failure to comply with these terms may result in dismissal from the academy without refund.
